What our case studies show about road traffic accident claims

Every road user owes a duty of care to everyone else on the road. When another driver breaks that duty and you're hurt, you may be able to claim.

Drivers must follow the rules of the road

A driver who speeds or crosses onto the wrong side of the road and causes a crash is usually found to be at fault. In our £50,000 case, the other driver did both.

The Highway Code

Psychological injuries count

Anxiety, PTSD and travel anxiety are real injuries. With medical evidence, they're included in your claim alongside your physical injuries, as they were for our client.

Insurance pays your compensation

Drivers must be insured, so compensation is usually paid by the at-fault driver's insurer. If the driver was uninsured or can't be traced, the Motor Insurers' Bureau may compensate you.

Road Traffic Act 1988

Could you claim for a road traffic accident?

You may be able to claim compensation if:

  • You were injured as a driver, passenger, cyclist, motorcyclist or pedestrian
  • The accident was caused, at least partly, by another road user
  • It happened in the last three years, though there are exceptions, for example for children

Road traffic accident case studies: FAQs

Are these real road traffic accident cases?

Yes. They're based on real road traffic accident claims handled by NJS Law's personal injury team, the solicitors behind Injuries Direct. Some details are kept anonymous to protect our clients' privacy.

Will my claim be worth the same?

Not necessarily. Compensation depends on your injuries, your recovery and the financial losses you've had, such as lost earnings and vehicle damage. Past results don't guarantee future outcomes, but we'll look at your situation for free and explain what your claim could include.

Can I claim if I was partly to blame?

Often, yes. If you were partly responsible, for example because you weren't wearing a seatbelt, your compensation may be reduced to reflect your share of the blame, but you may still be able to claim.

What if the other driver was uninsured or drove off?

You may still be able to claim. The Motor Insurers' Bureau compensates people injured by uninsured or untraced drivers. Talk to us and we'll explain how it works.

Is there a time limit for a road traffic accident claim?

You usually have three years from the date of the accident to start a claim. There are exceptions, for example for children, so get in touch even if your accident was some time ago.
