Can I make a personal injury claim?
You can usually make a personal injury claim if three things are true: someone else owed you a duty of care, they were at least partly at fault, and you were injured as a result. Most claims must start within three years of the accident.
- Someone else, such as a driver, employer or business, owed you a duty of care
- They breached that duty, at least in part
- You suffered a physical or psychological injury because of it
Time limits at a glance
- Most injury claims
- 3 years from the accident
- Children
- 3 years from their 18th birthday
- Injury diagnosed later
- 3 years from the date of knowledge

How much compensation could I get?
Compensation depends on how serious your injury is, how long recovery takes and what it has cost you. It's made up of two parts:
- General damages for pain, suffering and loss of amenity, valued using the Judicial College Guidelines.
- Special damages for financial losses: lost earnings, care from family, travel, medical and therapy costs, and adaptations to your home or car.

Personal injury claim FAQs
How long do I have to make a personal injury claim?
Generally three years from the date of the accident, under the Limitation Act 1980. For children, the three years starts on their 18th birthday. If you only later realised your injury was caused by someone's negligence, time can run from that date of knowledge.
Can I claim if the accident was partly my fault?
Yes, you may still be able to claim. If you were partly responsible, your compensation is reduced to reflect your share of the blame. This is called contributory negligence. We'll give you an honest view of how it might affect your claim at the start.
How does no win no fee work?
No win, no fee is a Conditional Fee Agreement. If your claim is unsuccessful, you don't pay our fees. If it succeeds, a success fee may be deducted from your compensation, plus any After the Event insurance premium. We explain this clearly before you sign.
How much compensation could I get?
It depends on the severity of your injury, your recovery and your financial losses. General damages are valued using the Judicial College Guidelines; special damages cover costs such as lost earnings, care and travel. We can give you an indication once we understand your injury.
Will I have to go to court?
Most personal injury claims settle without a court hearing. Court proceedings may be started if the other side won't agree a fair settlement, but even then most claims settle before trial. We'll prepare you fully if a hearing is ever needed.
What evidence do I need?
Useful evidence includes photos of the scene and your injuries, witness contact details, medical records, an accident book entry or police reference, and receipts or payslips showing your losses. Don't worry if you don't have everything; we can help gather it.
Is Injuries Direct a law firm?
Yes. Injuries Direct is a trading name of NJS Law Limited, a firm of solicitors authorised and regulated by the Solicitors Regulation Authority (SRA number 8006550).
