Lorry crashes into house

A woman has been successful in her personal injury compensation claim this month after she suffered trauma and distress when a lorry crashed into the house where she was residing after an operation.

Ms Alison Bradford had been recovering from an eye operation at the time the lorry ploughed into the home. The crash caused severe structural damage to the house and also caused debris to get into her eye, for which she had to back to hospital to her have her bathed and checked for infection.

The lorry in question belonged to Stoneyhill Waste Management. After the collision occurred, Ms Bradford, who is 31 years of age, contacted her legal team and pursued a personal injury compensation claim against the company, as she claims the incident left her psychologically distressed and she is now suffering from an eating disorder.

The personal injury compensation claim was settled out of court and she was awarded £300,000 by Stoneyhill Waste Management, which is located in Longhaven.

A spokesperson from the company has commented on the case and said: “It would not have been worth continuing to a two-week trial at the Court of Session given the high costs that would have been involved.”

Workman receives six-figure compensation payout

A worker who was left disabled due to an accident at work has been successful in his personal injury compensation claim and has received what is said to be a six-figure payout.

It was heard the workman, who remains unnamed, was carrying out work with his colleague when he sustained a serious fracture to his knee and leg, when a stack of steel beams fell on top of him.

The workman was immediately taken to hospital, where he was treated by medical staff and he also required emergency surgery to his leg. Although the fracture healed, the injured workman is still in a considerable amount of pain and suffers from severe pains in his leg. He has also been advised that he may need to have knee replacement surgery in the future.

As a result of the accident at work, the injured man was unable to carry on with his role in the company as a manual worker. The injured man is now struggling to find new employment.

After the accident at work occurred, the injured man contacted his legal team and pursued a personal injury compensation claim. During proceedings, the injured man’s employer admitted liability for the injuries he sustained and a six-figure sum was eventually agreed upon as settlement.

Boy impales face on spikes near home

A mother is pursuing a personal injury compensation claim on behalf of her son, after he sustained serious injuries to his face, when he became impaled on railings.

It was heard that over a month ago, Mrs Clare Metson’s son, who is 6 years of age, was playing near his home when he fell on the spikes.

Mrs Metson is asking for the Old Ford Housing Association, who are in charge of the estate where Mrs Metson lives, to cover up the spikes that injured her son.

Mrs Metson has commented on her son’s injuries and said:

“Alfie came running home with his mouth hanging off. His lip had come away and was hanging like a flap. I could see his teeth even though his mouth was shut. He was in so much shock he didn’t realise what had actually happened.”

After the accident occurred, the 6 year old boy had to go to hospital, where he had to undergo 4 and half hours of surgery and he also required 170 stitches.

Mrs Metson states that she believes her son will be scarred for life and may require plastic surgery in the future.

A personal injury compensation claim has been pursued against the Old Ford Housing Association, and a decision on how much compensation will be paid has yet to be made.

Three year old injured in hotel accident

A father of a young girl is pursuing a personal injury compensation claim this month, after his 3 year old daughter sustained cuts to her chin when she was on a family holiday.

It was heard that the 3 year old girl had been walking in the hotel past the restaurant with her brother and her parents. The toddler tripped over a metal water service cover, which was said to have been sticking up from the floor. The young girl then fell forward and hit her chin on the block paving. The toddler was said to have been very distressed due to the pain that she was in.

The 3 year old girl was immediately taken to hospital, where the opening in her chin was treated by medical staff, but it was said that there may be a possibility that the injuries she sustained may leave scar damage.

The medical report that was issued sides in favour of the family and the plastic surgeon states that the scars are more likely to take longer to heal due to her having red hair. The surgeon said:

“Scars take longer to mature in children, and particularly in redheads. It is likely this process will take at least two years.”

The father of the young girl is now pursuing a personal injury compensation claim against the hotel and is hoping for a payout of at least £4,000 for his daughter.

Motorcyclist to sue Suzuki due to personal injury

A motorcyclist is pursuing a personal injury compensation claim and is hoping to receive £300,000 after he sustained severe injuries when the frame of his motorbike split in half.

The motorcyclist, who remains unnamed and who is 29 years of age and from New Longton near Preston, was participating in a practice event held in the Isle of Man, known as the Manx Grand Prix.

It was heard that the motorcyclist was riding on his Suzuki GSX-R750 at around 80 miles per hour in one of the practice sessions, when he lost control of the motorbike and it dropped away from him.

The high court writ has said the following:

“He went into a right hand bend. Suddenly without warning he felt the motorbike drop down and away from him. [He] had not skidded or collided with anything. [He] lost control and became unseated. The motorbike span and collided with a stone wall on the left hand side of the circuit.”

After the accident occurred, the injured motorcyclist was airlifted to hospital due to him suffering with severe leg injuries. He had to have plastic surgery and also had to have numerous operations to help repair the damage. As a result of the injuries he sustained, the injured man had to give up his job, which paid him up to £40,000 a year.

Compensation for injured soldiers, MoD argues for cuts.

Compensation claim could be cut if the MoD is successful in their fight to decrease the award of compensation for injuries suffered by servicemen and women.

One of the two British soldiers that are affected by this row is Light Dragoon Anthony Duncan, who was injured when a bullet was shot through his leg in Iraq in 2005. He was originally awarded £9,250 but was later increased to £46,000 after the soldier appealed against the first sum. Duncan has only just been able to return to the army in active service after two years of rehab, he is now serving on a six-month tour of Afghanistan started in April this year.

The other soldier affected was Marine Matthew McWilliams who was firstly given £8,250 after he fractured his thigh during military training, but was later awarded £28,750 after he also appealed.

The MoD’s argument against the compensation awarded to these men is that soldiers should only be able to claim for the initial injury and not the subsequent effects on the soldiers’ health. Many connected to the MoD have said that the compensation is given based on the injury at the time of the accident, no the physical condition of these men at the time of the trial. If this argument is successful, this change will not only affect these men but also any soldiers injured in the future.

However, this view is not shared by all; for example, the High court who originally upheld these compensation increases for the soldiers described the argument as ‘absurd.’ Also, many other military personnel, especially those who have been injured whilst in the army also voice their concerns in the outcome of this row as it is known that soldiers have struggled to be awarded enough money in the past to cope with serious injuries. For many people, cuts to these not overly generous sums of compensation will not be taken lightly.

Man to receive millions in personal injury compensation

A man who is pursuing a personal injury compensation claim could be looking at receiving millions of pounds, after the medical treatment he received after a road traffic accident was said be inadequate for the injuries that he sustained.

The man, who remains unnamed and who is 29 years of age from Romford in Essex, sustained severe injuries when he was involved in a road traffic accident, which has now left him paralysed due to a spinal injury.

It was heard that the when the accident occurred, the man had unfastened his seatbelt to see to a baby in rear of the car while his partner was driving the vehicle. Unfortunately, while he was doing so his partner collided with another vehicle.

When the injured man pursued his personal injury compensation claim, he claimed that the medical staff involved with his care after the accident are partly liable for his paralysis, as they failed to identify a deteriorating neurological condition.

During court proceedings, the judge ruled that the hospital involved had to pay 80 percent of the damages due and the insurance company of the injured man’s partner were liable for the other 20 percent. It is believed that the injured man could be looking at a compensation payout totalling between £2 and £3 million.

Construction worker injured in accident at work

A construction worker has been successful in his personal injury compensation claim, after he was injured due to an accident at work, when he was assisting the build of the new Wembley Stadium.

It was heard that the man was injured when he was on site at the new stadium in 2005. As he was carrying out his work, he was hit in the eye with a piece of galvanised iron.

The construction worker, who remains unnamed and who is 35 years of age has commented on the accident at work and said:

“I should have been supplied with the correct goggles. I’ve learnt to live with the end result of this accident and I don’t let it affect my life, but I hate to think how I would have coped if I had lost my sight.”

The injured construction worker now suffers with blurred vision due to the accident at work. After the accident occurred, the injured man contacted his personal injury solicitor and pursued a personal injury compensation claim against his employers.

During court proceedings it was heard that the construction worker should have been provided with safety glasses, which would have protected his eyes from all angles. The company were found negligent for not providing necessary safety equipment and the injured construction worker was awarded £6,500 in compensation for injury.

Boy sustains injuries in cycling accident

A mother is pursuing a personal injury compensation claim on behalf of her son, when he sustained damage to his face as a result of a cycling accident.

It is reported that Mrs Lynn Baxter intends to make the personal injury compensation claim after her son, Joe, who is 10 years of age, was riding his bike along a stretch of grass located near his home. As he was cycling the young boy fell 3 feet down a hole.

Joe Baxter did not see the drop and he then hit a row of bricks that were along the top of a retaining wall, which then caused him to fall and sustain injuries to his face.

Joe was immediately taken to the Queen Elizabeth Hospital where he was treated by medical staff. The boy sustained injuries to his face and also cuts and bruises to his elbow. However, he was lucky enough not to have broken anything.

The boy’s mother, Mrs Lynn Baxter complained to the local council, claiming that there was no warning of a sudden drop. Mrs Baxter has commented on the incident and her son’s injuries and said

“It was a good three-foot drop. The blood was gushing out of his nose. He was lucky he did not fracture his skull.”

Workman loses fingers in accident at work

A man who lost all four of fingers due to an accident at work has received a six figure sum for his personal injury compensation claim.

The injured man, who remains unnamed and who is 49 years of age, sustained his injuries when he was cleaning a piece of machinery. It was heard that his was crushed in between the rollers on the machine.

The injured man has said that the he did not realise that the piece of machinery had been running still, due to the room being poorly lit and it was extremely noisy.

Due to the accident at work, the man lost four of his fingers. His fingers could not be saved and the rest of the skin on his hands was stripped away by the rollers inside the machine. The injured workman was immediately rushed to hospital, where he had to undergo 14 operations, one of which included the amputation of his thumb. The injured man is now registered as a disabled person and requires the use of a prosthetic limb.

After the accident at work occurred, the injured man pursued a personal injury compensation claim against his employer and has received a six figure sum in compensation for injury. The man’s employers were also fined £50,000 by the Health and Safety Executive, as they did not have sufficient lighting in the workplace, which meant that staff were working in a dangerous and hazardous environment.
