Birth Injury Compensation

Childbirth is a far safer procedure now than it ever has been. Unfortunately, there are occasional problems which can cause injury to the baby or the mother. Every time a woman gives birth there are potential risks involved. However, with the correct medical care and control, the risks can be massively decreased.

Complications during pregnancy or labour can be very traumatic for the mother, father and close family. Having a baby is meant to be the happiest, most important time in someone’s life, and therefore if this is destroyed by unnecessary difficulties, the effects can be long-lasting.

Currently there are 700,000 successful childbirths in the UK every year. However, mainly down to medical negligence, around seven in every 1000 babies suffers with an injury during birth.

Problems during pregnancy or labour can largely be down to the medical negligence of those managing your care. If a doctor or midwife has not delivered the appropriate medical treatment throughout your pregnancy and delivery, they may be liable for a birth injury compensation claim against them.

Birth Injury Types

Birth injuries can happen to the mother and/or the baby anytime through pregnancy, labour or birth. Some of the most common birth injuries include:

  • Caesarean delivery problems – Not being carried out properly can lead to excessive bleeding, causing infection. Sometimes caesareans are wrongly delayed causing the baby to be starved of oxygen.
  • Cerebral palsy – Lack of monitoring of the babies condition can cause oxygen starvation which sometimes leads to this.
  • Infections – Caused by lack of hygiene after childbirth, making mother and/or baby ill. Can be fatal in extreme cases.
  • Pre-eclampsia – A hypertension caused by high levels of protein in the urine. Can cause complications for mother and the baby foetus.
  • Umbilical cord complications – The cord is vital for delivering oxygen to the baby. If this is squashed it can starve the baby or air, as can being wrapped around the baby’s neck during birth.
  • Vaginal tears – Painful to the mother and need to be recognised and stitched up appropriately.
