Slip, Trip and Fall Accident Claims

A common workplace injury; slipping, tripping or falling can have a huge affect on someone’s life. Although it may not sound as severe as being involved in a road traffic accident for example, lives can be destroyed due to a nasty slip, trip or fall at work, especially when it has been caused through the fault of someone else.

Slip, trip and fall accidents are usually preventable, and are often the result of employer negligence. In not delivering appropriate health and safety training to staff, or breaching health and safety regulations themselves, they are likely to face compensation claims against them.

Work environments where slips, trips and falls can happen include:

  • Offices
  • Schools
  • Restaurants
  • Shops
  • Factories

In any case, your slips, trips and falls claim will be made against the third party at fault for your injury. Usually, in the case of an employer any accident at work compensation claims against them are covered by their employers’ liability insurance, which they are legally obligated to have in order to protect their employees from injuries they may suffer whilst at work.

Slips, trips and falls can be very dangerous if they happen in the wrong type of environment. They can often result in bad sprains, fractures, broken bones or concussion, depending on what area of the body is affected as a consequence.

Falling over Objects

Workplace Health, Safety and Welfare Regulations Act of 1992 gives help to anyone who has fallen over and suffered a workplace injury. Regulation 12 of the Act requires that floors and any traffic routes should be free from holes, slopes, slippery surfaces or things that are going to cause someone to slip, trip or fall. The regulations use the word 'shall' and not 'may' or 'ought to' and therefore employers are under a very strict duty to comply with these regulations.

If you fall at work and suffer an injury these regulations can help you recover accident compensation for your injury and/or loss of earnings. If employers have simply been negligent they are liable to pay you damages. Employers are obliged in areas likely to get wet to use slip-resistant coatings and to carry out regular risk assessments to ensure that areas are not a slipping or tripping hazard.
